Elements and Performance Criteria

1. Demonstrate knowledge of relevant legislation and voluntary compliance
   • Infringements issued are correct, complete and able to be justified in court.
   • Legislation can be explained when required.
   • Voluntary compliance is understood and used to inform decision making regarding breaches.
   • Voluntary compliance is achieved in negotiations with members of the public.
2. Detect possible breaches
   • Possible breaches are detected and recorded in accordance with legislative and council requirements.
3. Investigate alleged breaches
   • Relevant details are checked and accurately recorded.
   • Information is assessed and an appropriate decision is made in accordance with legislation and council policies and procedures.
   • Consultation is conducted to achieve a resolution.
   • Options and legislation are explained to the offending party.
   • Practical suggestions are combined with fair and legal action to achieve compliance.
4. Report outcomes of actions taken to achieve compliance
   • Report describing actions and related incidents is produced in accordance with organisational policies and procedures.

Evidence Required

Overview of assessment requirements	A person who demonstrates competency in this unit will be able to perform the outcomes described in the elements to the required performance level detailed in the performance criteria The units skill and knowledge requirements must also be demonstrated For example knowledge of the legislative framework and safe work practices that underpin the performance of the unit are also required to be demonstrated
Critical aspects of evidence to be considered	The demonstrated ability to investigate complaints detect breaches issue notices compile reports provide accurate information
Context of assessment	on the job or in a simulated work environment written or oral test roleplay
Method of assessment	The following assessment methods are suggested observation of the learner performing a range of workplace tasks over sufficient time to demonstrate handling of a range of contingencies written and oral questioning to assess knowledge and understanding completion of workplace documentation thirdparty reports from experienced practitioners completion of selfpaced learning materials including personal reflection and feedback from trainer coach or supervisor
Evidence required for demonstration of consistent performance	Evidence will need to be collected over time across a range of variables
