Elements and Performance Criteria

1. Define legal issues
   • Analyse information to determine factual situation.
   • Evaluate information to identify legal issues requiring research.
2. Undertake research
   • Define search parameters to narrow the scope of enquiry.
   • Identify sources of law to address the identified legal issue.
   • Develop research strategies based on subject, case, legislation, instrument or other relevant search terms.
   • Implement research strategies to locate sources of law.
3. Identify legal principles
   • Interpret sources of law to facilitate critical analysis.
   • Analyse sources of law critically to distil the legal precedent and determine application to the legal issue.
   • Formulate response to the legal issue based on research.
   • Communicate responses to inform stakeholders.

Performance Evidence

Evidence required to demonstrate competence must satisfy all of the requirements of the elements and performance criteria. If not otherwise specified the candidate must demonstrate evidence of performance of the following on at least one occasion.

Knowledge Evidence

Evidence required to demonstrate competence must satisfy all of the requirements of the elements and performance criteria. If not otherwise specified the depth of knowledge demonstrated must be appropriate to the job context of the candidate.
